Dispatch provides enterprises with a mobile extension for their existing systems and offers a self-serve set of products and APIs for marketplaces and developers. Businesses rely on Dispatch to enable their customers to instantly find and book a scheduled or immediate service either online or through a smartphone, and allow the customer to track the arrival of their provider in real-time.

Your Acceptance

Welcome to the Terms of Service for Dispatch, Inc.’s API service (“Service”) website (“Site”) and its mobile and web-based applications (collectively the “App”). This is an agreement (“Agreement”) between, Dispatch, Inc. (“Dispatch" “us,” “our,” or “we”), and you, a user of our Service, Site or App or another of our services. By clicking agree or by accessing our Service, App or Site or using any of Dispatch’s services, you agree to be bound by this Agreement and Dispatch’s privacy policy.



PLEASE READ THE TERMS OF SERVICE CAREFULLY BEFORE USING THE APP OR THE WEBSITE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE DISPATCH’S APP OR OUR WEBSITE.



Users of our app and our website must be 18 or above. If you are under the age of 18 please stop using our Site and Service immediately.



Description of Service

Dispatch offers users a simple way for service providers to manage their information and jobs through an intuitive Service, Site and App.



DISPATCH Accounts

To use Dispatch, you are required to create a unique profile called a “Dispatch Account”. Account registration requires you to submit certain personal information, as is further described in and governed by our Privacy Policy. You agree to submit accurate, up-to-date, complete, and truthful information when creating a Dispatch Account. We have the final discretion in granting accounts and reserve the right to reject users without explanation. You are responsible for all activity that occurs under your account, and you agree to maintain the security and secrecy of the username and password assigned to your Dispatch Account. You may only possess one Dispatch Account.



When creating a Dispatch Account, you will be asked to designate a preferred payment method. Dispatch does not collect or retain payment card information.



END USER LICENSE AGREEMENT

The use of the Dispatch API Service (the “Service”) Website (the “Site”) and Mobile Applications (the “App”) is governed by the following end user license agreement. By using the Service, Site or downloading and using the App, you acknowledge that this end user license agreement is between you and Dispatch, not Apple, and that Dispatch, not Apple, is solely responsible for the App.



  • Scope of License: Subject to these Terms of Service, Dispatch grants you a non-transferrable, non-exclusive license to use the Dispatch Service, Site & App for your sole use. Also subject to these Terms of Service, Dispatch grants you a non-transferrable, non-exclusive license to use a copy of the App downloaded solely in connection with the other Dispatch Services on your iOS or Andriod Device.
  • Certain Restrictions: The rights granted to you by these Terms of Service are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit any Dispatch Service, App or Site; (b) you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the Dispatch Service, App or Site, except to the extent the foregoing restrictions are expressly prohibited by applicable law; (c) you shall not access the Dispatch Service, App or Site in order to build a similar or competitive service or application; (d) except as expressly stated herein, no part of the Dispatch Service, App or Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, or (e) you shall not remove or destroy any copyright notices or other proprietary markings contained on or in any Site or App. Any future release, update, or other addition to functionality of the Dispatch Service, App or Site shall be subject to these Terms of Service, unless otherwise provided in terms associated with such addition.
  • Modification: Dispatch reserves the right, at any time, to modify, suspend, or discontinue the Dispatch Service, Site or App or any part thereof with or without notice. In the future we may offer additional services, features, functionalities and in-app purchases. You agree that Dispatch will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Dispatch Service, App or Site or any part thereof.
  • Ownership: The Dispatch Service, App or Site provided to you is licensed to you and not sold. Dispatch (and its licensors, where applicable) own all right, title and interest, including all related intellectual property rights, in and to the Dispatch Service, App or Site. These Terms of Service are not a sale and they do not convey to you any rights of ownership in or related to the Dispatch Service, App or Site. The Dispatch name, logo, and the product names associated with the Dispatch Service, App or Site belong to Dispatch, Inc. (or its licensors, where applicable), and no right or license is granted to use them by implication, estoppel or otherwise. Dispatch (and its licensors, where applicable) reserve all rights not granted in this Agreement.
  • CONTENT

    Certain features of the Dispatch Service, App or Site allow you to post, submit, publish, share, store, or manage (a) ideas, opinions, recommendations, data and information, including Information and (b) literary, artistic, musical, or other content, such as photos and videos (both “Content”).  By posting or publishing Content, you represent and warrant to us that you have all necessary rights to distribute Content to us, either because you are the author and have the right to distribute the same, or because you have the appropriate distribution rights, licenses, consents, and/or permissions to use, in writing, from the copyright or other owner of the Content. You further represent and warrant that none of the Content you post or publish contains financial, privileged, confidential, personally identifiable or personal information of any kind whatsoever. You hereby grant to Dispatch and our authorized personnel a worldwide, royalty-free, fully-paid, non-exclusive, transferable (in connection with an assignment of the Agreement), sublicensable (as necessary to perform the Services) license to copy, publicly perform, publicly display, publish, distribute, create derivative works of, and otherwise exploit information and Content as we in our sole and absolute discretion deem appropriate to perform and to promote (subject to your account settings) the Dispatch Service, App or Site and in accordance with these Terms of Service. This license ends when you disable Client Materials or your account, unless Client Materials have been shared with others and they have not deleted it. You acknowledge and agree that we will own all right, title, and interest in and to any materials, content, or other works of authorship created by us or on our behalf and used in connection with the Dispatch Service, App or Site. We acknowledge and agree that, as between you and Dispatch, you will own all right, title, and interest in and to Content you provide and to Client Materials.



    Third party services and content

    The Dispatch Service, App or Site are made available or accessed in connection with third party services and content (including advertising) that Dispatch does not control. You acknowledge that different Terms of Service or service, and different privacy policies may apply to your use of such third party services and content.



    Use of DISPATCH

    When using Dispatch, you are responsible for your use of the Dispatch Service, App or Site, and for any use of Dispatch made using your account. You agree not to access, copy, or otherwise use Dispatch, including our intellectual property and trademarks, except as authorized by these Terms of Service or as otherwise authorized in writing by Dispatch. You agree not to use the Dispatch Service, App or Site to:



  • You will not copy, distribute or disclose any part of the Dispatch Service, App or Site in any medium, including without limitation by any automated or non-automated “scraping”;
  • You will not submit fraudulent workers compensation claims, insurance applications, insurance claims, or otherwise attempt to defraud Dispatch, its Insurance Partners, or any other party in connection with your use of the Dispatch Service, App or Site;
  • You will not use any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access Dispatch Service, App or Site in a manner that sends more request messages to Dispatch servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that Dispatch grants the operators of public search engines revocable permission to use spiders to copy materials from the publicly available searchable indices of the materials, not caches or archives of such materials);
  • You will not attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Dispatch Service, App or Site;
  • You will not take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure;
  • You will not post or publish Content containing financial, confidential, privileged, personally identifiable or personal information on the Dispatch Service, App, or Site;
  • You will not upload invalid data, viruses, worms or other software agents through the Dispatch Service, App or Site;
  • You will not collect or harvest any personally identifiable information, including account names, from the Dispatch Service, App or Site;
  • You will not access the Dispatch Service, App or Site through any technology or means other than those provided or authorized by Dispatch;
  • You agree not to stalk, harass, bully or harm another individual who uses our Dispatch Service, App or Site;
  • You agree not to impersonate any person or entity or misrepresent your affiliation with a person or entity;
  • You agree to use our software only in a safe manner and in compliance with all laws, you explicitly agree that you will not use the Dispatch Service, App or Site for any criminal communications or for transmitting any child pornography;
  • You agree that you will not hold Dispatch responsible for your use of the Dispatch Service, App or Site;
  • You agree not to violate any requirements, procedures, policies or regulations of networks connected to Dispatch;
  • You agree not to interfere with or disrupt the Dispatch Service, App or Site;
  • You agree not to hack, spam or phish us or other users;
  • You agree to provide truthful and accurate Content;
  • You agree to not violate any law or regulation and you are responsible for such violations;
  • You will not use the Dispatch Service, App or Site to post any false, misleading, unlawful, defamatory, obscene, invasive, threatening, harassing, inflammatory, fraudulent Content;
  • You agree not to cause, or aid in, the destruction, manipulation, removal, disabling, or impairment of any portion of the Dispatch Service, App or Site, including the de-indexing or de-caching of any portion of the Dispatch Service, App or Site from a thirty party’s website, such as by requesting its removal from a search engine;
  • You will not upload any Content to the Dispatch Service, App or Site that includes any third party intellectual property unless you have permission from the owner to use it in the specific manner that you used it;
  • If you are discovered to be undertaking any of the aforementioned actions your privileges to use the Dispatch Service, App or Site may at our discretion be terminated or suspended.



    Payment

    You understand and agree that use of Dispatch’s Services may result in charges to you for products or services you receive from third party service providers (“Partners”). Dispatch will facilitate your payment of fees, premiums, and/or taxes on behalf of the Partner, as such Partner’s limited payment collection agent. All charges shall be inclusive or applicable taxes as required by law. All charges are final and non-refundable.



    Payment of our Partners fees and costs are due immediately and payment will be facilitated by Dispatch using the preferred payment method designated in your Dispatch Account, after which Dispatch will send you a receipt via email.



    Software and Site Availability

    We do not guarantee that the Dispatch Service, App or Site will always be available, work, or be accessible at any particular time. Only users who are eligible to use the Dispatch Service, App or Site may do so. We reserve the right to terminate access for anyone. We cannot guarantee that the Dispatch Service, App or Site will work as advertised, or that it will give you the desired results.



    Taxes

    You agree that you are responsible for all taxes and fees associated with your use of the App, Site and Service. Although we may deduct nexus taxes or other taxes, you agree that if we do not, you will pay any associated taxes, levies, or fees.



    Compliance With All Laws and Regulations

    Dispatch is not responsible for your violation of any laws while using the Dispatch Service, App or Site. Users must comply with all local, state, or federal laws regarding your use of the Dispatch Service, App or Site. The Dispatch Service, App or Site are void where prohibited.



    Intellectual Property Rights

    The design of the Dispatch Service, App or Site, along with Dispatch created text, templates, scripts, graphics, interactive features and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Dispatch, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Dispatch reserves all rights not expressly granted in and to the Dispatch Service, App or Site. You agree to not engage in the use, copying, or distribution anything contained within the Dispatch Service, App or Site unless we have given express written permission.



    Representations and Warranties

    OUR APP, SITE AND/OR SERVICE ARE OFFERED “AS-IS”, INCLUDING ANY ERRORS, BUGS OR OTHER TECHNICAL ISSUES. YOU AGREE THAT WHILE USING OUR APP, SITE, OR SERVICE, YOUR RESULTS MAY VARY AND YOU MAY NOT ACHIEVE ANY DESIRED RESULTS. WE EXPRESSLY DISCLAIM ALL WARRANTIES EITHER EXPRESS OR IMPLIED. OUR APP, SITE OR SERVICE MAY NOT BE FIT FOR A PARTICULAR PURPOSE AND MAY NOT WORK OR BE APPLICABLE WHERE YOU RESIDE. WE MAKE NO REPRESENTATIONS OR WARRANTIES AS TO THE REASONABLE SKILL AND CARE INVESTED IN OUR SERVICE, SATISFACTORY QUALITY OF OUR SERVICE, MERCHANTABILITY OF OUR SERVICE OR THAT OUR SERVICE IS NON-INFRINGING. FURTHERMORE, WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE APP, SITE OR SERVICE WILL MEET ANY REQUIREMENTS OR NEEDS YOU MAY HAVE, THAT THE APP, SITE OR SERVICE WILL OPERATE ERROR FREE OR IN AN UNINTERRUPTED FASHION, THAT ANY DEFECTS OR ERRORS IN THE APP, SITE OR SERVICE WILL BE CORRECTED, OR THAT THE APP, SITE OR SERVICE IS COMPATIBLE WITH ANY PARTICULAR PLATFORM. DISPATCH IS NOT OBLIGATED TO PROVIDE YOU ACCESS TO OUR APP, SITE AND SERVICE. IN THE EVENT OF ANY PROBLEM WITH THE APP, SITE OR SERVICE, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE APP, SITE OR SERVICE.



    Limitation of Liability

    IN NO EVENT SHALL DISPATCH ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM (I) YOUR USE OR INABILITY TO USE THE APP, SITE OR SERVICE ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) ANY PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR APP, SITE OR SERVICE, (III) ANY INTERRUPTION, MISINFORMATION, INCOMPLETE INFORMATION, OR CESSATION OF TRANSMISSION TO OR FROM OUR APP, SITE OR SERVICE TO YOU, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR APP, SITE OR SERVICE BY ANY THIRD PARTY, (V) ANY FAILURE OF ANY THIRD PARTY INFORMATION LISTED ON OUR APP, SITE OR SERVICE, INCLUDING ANY FAILURES OR DISRUPTIONS WHETHER INTENTIONAL OR UNINTENTIONAL OR (VI) ANY ERRORS OR OMISSIONS IN OUR APP, SITE OR SERVICE FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF OUR APP, SITE OR SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION



    For Jurisdictions that do not allow us to limit our liability: Notwithstanding any provision of these Terms, if your jurisdiction has provisions specific to waiver or liability that conflict with the above then our liability is limited to the smallest extent possible by law. Specifically, in those jurisdictions not allowed, we do not disclaim liability for: (a) death or personal injury caused by its negligence or that of any of its officers, employees or agents; or (b) fraudulent misrepresentation; or (c) any liability which it is not lawful to exclude either now or in the future.



    IF YOU ARE A RESIDENT OF A JURISDICTION THAT REQUIRES A SPECIFIC STATEMENT REGARDING RELEASE THEN THE FOLLOWING APPLIES. FOR EXAMPLE, CALIFORNIA RESIDENTS MUST, AS A CONDITION OF THIS AGREEMENT, WAIVE THE APPLICABILITY OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES, “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR." YOU HEREBY WAIVE THIS SECTION OF THE CALIFORNIA CIVIL CODE. YOU HEREBY WAIVE ANY SIMILAR PROVISION IN LAW, REGULATION, OR CODE THAT HAS THE SAME INTENT OR EFFECT AS THE AFOREMENTIONED RELEASE. YOUR ABILITY TO USE OUR APP, SITE OR SERVICE IS CONTINGENT ON YOUR AGREEMENT WITH THIS AND ALL OTHER SECTIONS OF THIS AGREEMENT. YOU AGREE OUR TOTAL LIABILITY TO YOU IS NOT MORE THAN $100 U.S. DOLLARS OR THE TOTAL AMOUNT YOU SPENT WHILE USING OUR APP, SITE OR SERVICE WITHIN THE LAST SIX MONTHS, WHICHEVER IS GREATER.



    Indemnity

    You agree to defend, indemnify and hold harmless Dispatch, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:



  • your use of and access to the Dispatch App, Site or Service;
  • your violation of any term of these Terms of Service;
  • your violation of any third party right, including without limitation any copyright, property, or privacy right; or
  • any claim that any of your Content caused damage to a third party.
  • This defense and indemnification obligation will survive this Agreement and your use of the Dispatch App, Site, or Service. You also agree that you have a duty to defend us against such claims and we may require you to pay for an attorney(s) of our choice in such cases. You agree that this indemnity extends to requiring you to pay for our reasonable attorneys’ fees, court costs, and disbursements. In the event of a claim such as one described in this paragraph, we may elect to settle with the party/parties making the claim and you shall be liable for the damages as though we had proceeded with a trial.



    COPPA Compliance

    Dispatch and its Services may only be used by persons 18 years and older. If you are under 18 please stop using our App and our Site, and do not submit any information to us.



    Choice of Law

    All matters relating to the App, Site or Service, and these Terms of Service and any dispute or claim arising under or relating to the Dispatch Service, App or Site or these Terms of Service, shall be governed by and construed in accordance with the internal laws of the state of Massachusetts, U.S.A. without giving effect to any choice of law provision of rule (whether of the state of Massachusetts or any other jurisdiction.)



    Forum of Dispute

    Any dispute relating in any way to your use of the App, Site, or Service, or your purchase of insurance through Dispatch shall be submitted to confidential arbitration in Massachusetts, U.S.A, except that to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court having jurisdiction. You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of Massachusetts. Arbitration under these Terms of Service shall be conducted pursuant to the Commercial Arbitration Rules then prevailing at the American Arbitration Association. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms of Service shall be joined to an arbitration involving any other party subject to these Terms of Service, whether through class action proceedings or otherwise. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with the use of the Dispatch App, Site, or Service or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever banned. No right or remedy of ours shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys' fees and expenses. No instance of waiver by us of our rights or remedies under these Terms of Service shall imply any obligation to grant any similar, future or other waiver.



    Force Majeure

    You agree that Dispatch is not responsible to you for anything that we may otherwise be responsible for, if it is the result of events beyond our control, including, but not limited to, acts of God, war, insurrection, riots, terrorism, crime, labor shortages (including lawful and unlawful strikes), embargoes, postal disruption, communication disruption, failure or shortage of infrastructure, shortage of materials, or any other event beyond our control.



    Severability

    In the event that a provision of this Agreement is found to be unlawful, conflicting with another provision of the Agreement, or otherwise unenforceable, the Agreement will remain in force as though it had been entered into without that unenforceable provision being included in it. If two or more provisions of this Agreement are deemed to conflict with each other’s operation, Dispatch shall have the sole right to elect which provision remains in force.



    Non-Waiver

    We reserve all rights permitted to us under this Agreement as well as under the provisions of any applicable law. Our non-enforcement of any particular provision or provisions of this Agreement or the any applicable law should not be construed as our waiver of the right to enforce that same provision under the same or different circumstances at any time in the future.



    Termination of Service

    We may terminate or suspend your Dispatch Account, or our App, Site, and/or Service without notice, though we will strive to provide a timely explanation in most cases. Please be aware that if we terminate service, you may be entitled to a refund if applicable. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.



    Assignment

    You may not assign your rights and/or obligations under this Agreement to any other party without our prior written consent. We may assign our rights and/or obligations under this Agreement to any other party at our discretion.



    Amendments

    We may amend this Agreement from time to time. When we amend this Agreement, we will update this page and indicate the date that it was last modified, make an announcement on our homepage or we may email you. You may refuse to agree to the amendments, but if you do, you must immediately cease using our App, Site and Service.



    Electronic Communications

    The communications between you and Dispatch use electronic means, whether you use our App, visit the Site, or use our API Service, or send Dispatch e-mails, social media, or other messages, or whether Dispatch posts notices on the App, Site, or Service or communications with you via e-mail, or social media. For contractual purposes, you (1) consent to receive communications from Dispatch in an electronic form; (2) agree that all terms, conditions, agreements, notices, disclosures, and other communications that Dispatch provides to you electronically satisfy any legal requirement that such communications would satisfy if it were to be in writing. The foregoing does not affect your statutory rights.



    California Users and Residents

    Pursuant to California Civil Code Section 1789.3, any questions about pricing, complaints, or inquiries about Dispatch must be addressed to our agent for notice and sent via certified mail to: 170 Milk Street, Second Floor, Boston, MA 02109. Lastly, California users are also entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

In this Privacy Policy (“Policy”), we describe how we collect, use, and disclose information that we obtain from visitors and users of our Service, Site and/or App.



    WHAT INFORMATION DOES DISPATCH COLLECT FROM ME?

    Dispatch collects certain information from you when you share that information with us or with select third parties, and when you use our App, our Site and our Service.



  • Personal Information: Dispatch may collect certain information from you, such as your name, address, email address, business name, telephone number, zip code, and other contact information. We call this information “Personal Information.” We don’t share Personal Information with third parties except as specified in this privacy policy.
  • Third Party Information: Dispatch works directly Third Party Partners to provide our Service. We may collect information about your current or future potential customers or client—including information about past or future jobs—from our Third Party Partners.
  • App Information: Dispatch collects information about you from our App. This includes your preferred language, your phone number, the make and model of your phone, your mobile operating system, your activities using the App the type of browser you are using, your IP address or other unique identifier, and your geolocation. We call this information “App Information.”
  • Analytics Information: Dispatch has partnered with Google Analytics and Segment Inc. to collect information about how our Site, App and Service is used. These companies collect information about how many times you visit our Site, what you visit when you explore our Site, and what other websites you visit before and after visiting our Site, among other data elements.   • Site Visit Information: Dispatch also collects certain types of non-personal information whenever you visit our Site. We may automatically collect the following information about your use of our Service, Site or App through cookies, web beacons, and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site, user our App and or use our Service; and the referring URL, or the webpage that led you to our Site, and the following: access time, browser type, domain name, IP address, page views and referring URL. We call this information “Site Visit Information.”
  • WHAT DOES DISPATCH DO WITH THE PERSONAL INFORMATION IT COLLECTS?

    Dispatch collects information from you to provide Services, to alert you to exciting opportunities, and to improve the quality and functioning of our mobile App and our Site. Dispatch does not sell or lease the information you share with third-parties, but we do share it under certain circumstances. You should read this section carefully to learn more about what we do with the information you share with us.



  • Dispatch’s use of your Personal, App, Analytics, and Site Visit Information: Dispatch uses Information you share with us to provide on-demand services and real-time work force tracking solutions. It also uses this information to enhance the quality of our Services, our App and our Site, to communicate with you, and to market additional products and services to you. We may also share your information with our affiliates and subsidiaries. Don’t worry; our affiliates and subsidiaries will be bound by this privacy policy and our terms of use.
  • Dispatch may share Personal, App, Analytics, and Site Visit Information with Service Providers: Dispatch may share your Personal, App, Analytics, and Site Visit Information with certain Third Party Partners to perform the Services, and to other third party vendors, services providers, contractors, or agents that provide certain services to us such as: order processing, customer relationship management, database storage and management, advertising, and direct marketing campaigns. Dispatch may also share your Personal Information and your location information with companies using our Services in the construction and home repair trades. We call this class of partners “Construction Partners.”
  • Acquisition or Sale. If Dispatch is acquired or sold to another company, either through merger or the transfer of substantially all our assets, or if we seek bankruptcy protection, Dispatch may transfer the information we have collected to another company.
  • Legal and law enforcement requests: Dispatch may also disclose, at its sole discretion, your Personal or Site Visit Information as required by law, or to comply with a legally binding request—like a subpoena, warrant, or similar legally enforceable request for information.


  • Also, Dispatch may sell, rent, or share non-personalized, aggregated data derived from its App, Site, and/or Service with third parties.



    DOES DISPATCH USE COOKIES OR BEACONS?

    “Cookies” are electronic files many websites place on a visitor’s computer to store information that makes each visit to a respective site more efficient. Dispatch may at its discretion use both “session” and “persistent” cookies on its Site. A session cookie stores information about you only while you are visiting our site, and is then deleted when you leave our site. Persistent cookies store information about you, your preferences, and information about other websites you visit, and it remains on your computer or device after you leave our Site. To remove cookies, you may configure your browser to clear all cookies, or configure it to reject cookies whenever you visit a new website. Please consult your browser’s user guide for specific instructions on removing cookies.



    “Beacons” are small graphic files with a unique identifier that are used to track a web or mobile site user’s online movements. Unlike cookies, beacons are embedded on websites, not downloaded on your computer or device. Dispatch may use beacons to better manage content on our Site and to improve the use and efficiency of our App.



    As we discussed above, Dispatch partners with Google Analytics to improve the quality of our Site. Google Analytics may install persistent cookies on your computer or mobile device to perform these services when you first visit our Site. This allows Google Analytics to track your activity on Dispatch’s Site, and on other websites you visit. You should be aware that Dispatch cannot control Google Analytics use of cookies, and their use is not covered by our Privacy Policy.



    DOES DISPATCH COLLECT PAYMENT CARD INFORMATION?

    Dispatch does not collect credit, debit, or other financial data on our App or its Site, and we never have access to that information. Dispatch uses Stripe https://stripe.com/us/privacy and Spreedly https://spreedly.com/privacy for credit card processing.



    DOES DISPATCH COLLECT LOCATION INFORMATION?

    Dispatch collects information about your location when you use our App. Dispatch shares this information with Construction Partners.



    Dispatch’s App will not work unless you have enabled location services on your device, and have given the App permission to access your location.



    DOES DISPATCH TRACK MY ACTIVITY ACROSS OTHER WEBSITES?

    Dispatch may track your activity across multiple websites. When you visit our Site, we automatically collect the name of the website you visited from (called the “referring page”) and the name of the website you chose to visit immediately after ours (called the “exit page”), and information about other websites you have recently visited. This information is used to improve our Site, but we cannot identify you from any information we receive from cookies (see “Does Dispatch Use Cookies or Beacons?”). Dispatch does not honor the “Do Not Track” settings available on most browsers. When Dispatch’s Site detects the Do Not Track signal from your browser, it will still collect referring and exit page information and other information when you visit our Site.



    CAN I CHOOSE TO STOP RECEIVING MARKETING MESSAGES FROM DISPATCH?

    Dispatch may send you newsletters and other messages, including marketing emails, about exciting developments with our business, and to alert you to other opportunities. You can always choose to stop receiving newsletters or other communications from us by clicking the “unsubscribe” link at the bottom of a Dispatch marketing message.



    CAN CHILDREN USE DISPATCH’S SITE OR APP?

    Our Site and our App are not directed at children under 18, and we do not knowingly collect personal or other information from children under 18. Simply put, Dispatch does not permit children users under the age of 18 to use our App, Site or Service to create accounts, or to perform any other type of activity. If you are the parent of a child under the age of 18, and you believe he or she has shared information with Dispatch, please contact us at privacy@dispatch.me so we can remove their information from our active systems.



    WHAT IF I LIVE OUTSIDE THE UNITED STATES?

    Dispatch is based in the United States, and our Site our Service and our App are hosted there. If you are visiting our Site from, or using our App in another country, the laws governing our Site and App’s collection and use of personal information may be different from the laws of your country. If you decide to visit our Site, use our App, or use our Services, or otherwise share Personal Information with Dispatch, you are agreeing to be governed by the laws of the United States, and you are expressly consenting to the transfer of your data to the United States.



    WHAT IF I FOLLOW A LINK TO A THIRD-PARTY WEBSITE?

    Dispatch’s Site and our App may contain links to third-party websites. Those websites are governed by their own privacy and data use practices and policies. Dispatch does not have control over the privacy practices of the advertisers or other third-parties operating these websites, and we have no control over how these third parties collect or use the information you chose to share with them.



    HOW DOES DISPATCH PROTECT MY INFORMATION?

    Dispatch takes the security of your personal information very seriously. Dispatch uses reasonable administrative, physical, and technical safeguards to secure the personal information you share with us. Despite these safeguards and our additional efforts to secure your information, Dispatch cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third-parties will not be able to defeat our security, and improperly collect, access, steal, or modify your personal information.



    CAN I ACCESS MY PERSONAL INFORMATION?

    You may modify personal information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site or App for a period of time.



    WILL DISPATCH CHANGE THIS PRIVACY POLICY?

    Dispatch may update our privacy policy to reflect changes to our App, Site or Service and to our information practices. If we make any material changes, we will notify you by posting a notice on our Site with a link to our revised policy or sending an email message associated with your Dispatch account.     Your Acceptance

    Dispatch, Inc. (“Dispatch" “us,” “our,” or “we”), knows that the security of your date is important. Dispatch offers users a simple way for service providers to manage their information and jobs. We offer services through our Dispatch API (our “Service”), mobile applications (our “App”) and our website (“Site”).



    To use Dispatch, you are required to create a unique profile called a “Dispatch Account” and share important information with us. In this Security Policy (“Policy”), we describe how we protect the data and information that we obtain from visitors and users of our Service, Site and/or App.



    By visiting our Site, using or downloading our app, or using any part of our Service, you agree that your data will be secured as described in this Policy. Your use of our Service, Site or App, and any dispute over data security, is subject to this Policy and our Terms of Service including its applicable limitations on damages and the resolution of disputes. Dispatch’s Terms of Service are incorporated by reference into this Policy.



    Information Security

    Dispatch works closely with its partners and clients to prevent unauthorized access to or unauthorized alteration, disclosure or destruction of information. We employ several security controls to encrypt and maintain the integrity of data at rest and in transit.



    Product Delivery Model

    Dispatch’s solutions are hosted on an Amazon Web Services (AWS), specifically the elastic cloud compute (EC2) service. We employ Amazon’s best practices to maintain and restrict access to its systems, networks, websites, and data, including all Customer Information. Data is transferred and accessed using secure protocols including Secure Shell (SSH), SSH File Transfer Protocol (SFTP), Secure Socket Layer (SSL), and/or Transport Layer Security (TLS). Access to AWS servers and infrastructure is limited, and all AWS servers are regularly updated with appropriate security patches.



    Systems Communication and Access

    Client applications and platform clients are authenticated via OAuth2 protocol (more at http://oauth.net/2/). Upon successful authentication application and client platforms are able to access segmented platform data. Account-level authentication provides access to managing data from multiple belonging organizations, while user-level authentication provides access to the data belonging to one Organization. User operations are logged and monitored. Every environment communicates via HTTPS protocol to protect sensitive data.



    The Dispatch Platform is distributed into Linux containers which have a password-less root-level user. Root level access is provided via lead DevOps engineer public key.



    We expose only those servers dedicated to running our Service and Site to public web traffic. Access to non-essential services and unnecessary network ports is blocked or disabled.



    Monitoring and Alerting

    Our servers are monitored with AWS (Amazon Web Service) CloudWatch monitoring and with DataDog. We use CloudWatch custom metrics for application monitoring as well as metrics derived from other solutions. Our monitoring solutions are monitored automatically, and are configured to alert appropriate personnel, who are on-call 24/7.



    Data Transmission

    Client applications and platform clients are authenticated via OAuth2. Upon successful authentication they get permissions to access their own platform data. Account-level authentication provides access to managing data from multiple belonging organizations, while user-level authentication provides access to the data belonging to one Organization. All user operations are logged. Every environment communicates via HTTPS protocol to protect sensitive data being transmitted over the internet. Our application servers and databases are located within the same VPC on AWS.



    Data Storage

    Data is stored on AWS, and within our application instances. Access to database servers is restricted and all API request to read or modify data are verified by authentication challenge and a permission check for legitimate traffic. Account-level authentication provides access to managing data from multiple belonging organizations, while user-level authentication provides access to the data belonging to one Organization.



    Data Retention and Disposal

    Dispatch retains and stores all data indefinitely. At client request, we will remove data containing personally identifiable information as defined under applicable law from our production environment. Such a request must be made in writing and must detail the scope of the request.



    Code Monitoring

    Dispatch’s code is secured in centralized GitHub repositories with access granted on an as need basis. All code is peer reviewed, includes automated test coverage through Continuous Integration and is quality tested prior to production deployments.



    Application Security

    Dispatch follows an agile development methodology, with security testing implemented throughout the entire software development lifecycle. We write automated test coverage and utilize continuous integration to validate adherence to strict API and data standards. Dispatch as needed conducts regular quality, performance, stress, security, and penetration testing.



    Issue Resolution

    Self-directed FAQ and help can be found on Dispatch’s ZenDesk support center. Additionally, questions or issues can be reported by contacting Dispatch through online live chat, email (support@dispatch.me) or by phone. Enterprise clients should directly contact their account manager. We will work to resolve all issues as quickly as possible.



    Backup Policy and Disaster Recovery

    Data is stored on Amazon Web Services along with our application instances. This includes solutions for temporary application state (locking / caching) , and daily databases backups.



    System Updates and Patching

    Dispatch relies on commercially available cloud computing services including AWS utilizing automatic notifications for and the application of critical security patches. All employee computers must have automatic notifications of updates and security patches enabled. As security patches are made generally available they are applied immediately.



    Change Management

    Dispatch iteratively develops and releases its Service, Site and Apps into development, QA and Production environments. All deployments follow a formal release management control process where applications are tested prior to deployment and clients are provided notice of up-coming changes. In the event of failed deployments, changes may be reverted to a previous version.



    Employee Training and Background Checks

    Dispatch has and annually updates its human resources data security policies and procedures to ensure its employees are sufficiently trained to uphold both the spirit and details of the Statement of Privacy and Security Controls. Additionally, Dispatch conducts background checks on all employees to ensure they are trustworthy and capable of working with sensitive data.



    Employee Training

    All employees are required to read and demonstrate proficiency with the concepts, rules and best practices laid out in the Statement of Privacy and Security Controls. Additionally, annual refresher training is held for all employees.
